General conditions governing the use of PhantomServer.net services

Prohibited Content and Activities

The following content and activities are strictly prohibited on our services:

  • Pornographic content (-18)
  • Excessively violent content or content that incites violence or hatred
  • Pyramid schemes
  • Defamatory or confidential content that violates privacy or personal data integrity
  • Phishing
  • Proxy scripts or services
  • IRC bots
  • SPAM
  • SCAM / Fraudulent or scam websites
  • Black market
  • Hacking activities
  • Denial-of-service attack generator scripts
  • Port scanning
  • HYIP
  • Spoofing
  • Torrentflux / Bittornado
  • Rapidleech or similar
  • Sites related to terrorism
  • Malware
  • Trolling
  • Botnets
  • Mailbombing
  • Spam generator scripts
  • Providing information that violates current law under Chilean legislation

Resource Usage

It is the client's obligation to keep their website in optimal condition so that it does not consume extra resources, except for customized or similar services where resources are assigned to the site or service in question.

In the event of excessive consumption that causes any impact or degradation of service performance, we reserve the right to suspend the problematic hosting account.

DMCA Policy on VPS Services (DMCA Friendly)

Valid DMCA notifications that cannot be ignored or filtered will be sent to the client so that they may remove the requested content within a period of less than 24 hours.

If the client is unable to remove the content within 24 hours, we reserve the right to block access to the specific reported URL or to temporarily suspend the service until the client takes the necessary content removal measures.

DMCA Policy on Hosting (DMCA Ignored)

The DMCA Ignored policy applies to cPanel, DirectAdmin and HestiaCP Hosting.

Client Responsibility

The client is responsible for all material published, disseminated, distributed or hosted on their hosting account, exempting Phantom Server from any liability or fault.

Limitation of Liability

Phantom Server shall not be liable for fortuitous service outages caused by the following types of events:

  1. Earthquakes and natural disasters that prevent delivery of the service.
  2. Outages of national and/or international links provided by external companies.
  3. Prolonged power outages that exceed the capacity for restoration by external companies.
  4. Loss of data and/or information deleted by the client.
  5. Misconfiguration and service failures due to misuse.
